Citing serious Federal government alleged abuse, a Federal judge on Monday rejected a Biden administration attempt to have the Missouri vs. Biden case (State of Missouri, et al. v. Joseph R. Biden, Jr., et al.) dismissed.
The case, brought by several state attorneys and other plaintiffs, has credibly demonstrated Federal government violations of First Amendment rights of American citizens, according to United States District Judge Terry A. Doughty of the Western District of Louisiana.
Doughty said in his ruling to allow the case to proceed, according to The Daily Signal, based on reporting from The Daily Caller News Foundation:
“Plaintiffs have clearly and plausibly alleged that Defendants engaged in viewpoint discrimination and prior restraints. As discussed in great detail above, Plaintiffs allege a regime of censorship that targets specific viewpoints deemed mis-, dis-, or malinformation by federal officials,” Doughty added. “Because Plaintiffs allege that Defendants are targeting particular views taken by speakers on a specific subject, they have alleged a clear violation of the First Amendment, i.e., viewpoint discrimination. Moreover, Plaintiffs allege that Defendants, by placing bans, shadow-bans, and other forms of restrictions on Plaintiffs’ social-media accounts, are engaged in de facto prior restraints, another clear violation of the First Amendment.”
Reacting to the Judge’s decision, Tracy Beanz of Undercover DC noted on Twitter:

NEW: Missouri v. Biden – the judge in the case has just DENIED the motion to dismiss. This lawsuit is moving forward. PAY. ATTENTION. It’s the most important civil liberties case in modern history.
New Civil Liberties Alliance, which is representing some plaintiffs in the case posted several reactions, as reported by Bakersfield.com:
“The US government used its vast power over social media and big tech to censor legitimate scientific and policy discussion about Covid during the pandemic. This was a gross violation of basic American civil liberties. Had free speech been permitted instead, perhaps many fewer Americans would have been harmed by destructive and epidemiologically useless policies like lockdowns, school closures, vaccine discrimination, toddler masking and much else. Missouri v. Biden is the most important First Amendment legal case in a generation, and I am pleased that it will be proceeding forward.”
— Dr. Jay Bhattacharya, Plaintiff, State of Missouri, et al. v. Joseph R. Biden, Jr., et al.
“Today’s remarkable decision marks an important victory for free speech in America. Unlike other courts before it, the district court recognizes that the federal government’s massive, far-reaching campaign of coercion and pressure on social media platforms to censor views that threaten the administration’s agenda is unlawful and violates our clients’ First Amendment rights.”
